Why Conflict Resolution? Alternative Dispute Resolution (ADR) refers to a variety of ways to resolve disputes other than through litigation or formal processes in a court of law.

"The courts of this country should not be the places where resolution of disputes begins. They should be the places where the disputes end after alternative methods of resolving disputes have been considered and tried."

Benefits of mediation (as compared to litigation) include:
  • Cost effective - organizations can minimize costs of dispute resolution
  • Expeditious - process may take one day or less
  • Achievement of more satisfactory outcomes - since agreement is jointly negotiated
  • Flexible - solutions are not limited by precedent/law and can be tailored to the individual situation
  • Non-confrontational - can preserve or improve relationships
  • Informal
  • Private and confidential - avoids public disclosure
  • Reduced stress
  • Solutions are sustainable since the parties design and agree to them
Mediation works. In Canada and the United States, experience has shown that about 80% of the cases in mediation settle on the first day. An additional 10% settle within a month of the initial mediation session.

Mediation can successfully be used to resolve disputes in any field.
